Terms of Service

Welcome to Get Cooked. These Terms of Service ("Terms") govern your use of the Get Cooked mobile application (the "App") operated by Get Cooked ("we", "us", or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App

1.1 Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

1.2 Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

1.3 Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Upload malicious content or code
  • Scrape, crawl, or use automated means to access the App beyond normal use
  • Violate the intellectual property rights of others

2. Subscriptions and Payments

2.1 Free and Pro Plans

The App offers a free plan with limited features and a paid Pro subscription with additional features. Feature limits are described within the App and may change.

2.2 Billing

  • Pro subscriptions are billed through Apple's App Store
  • Payment will be charged to your Apple ID account
  • Subscriptions automatically renew unless cancelled
  • You can manage or cancel subscriptions in your Apple ID settings

2.3 Refunds

Refund requests are handled by Apple according to their policies. We cannot process refunds directly.

2.4 Price Changes

We may change subscription prices. You will be notified in advance and changes will apply to subsequent billing periods.

3. Content and Intellectual Property

3.1 Your Content

You retain ownership of recipes, menus, and other content you create or import ("Your Content"). By using the App, you grant us a license to store, display, and process Your Content solely to provide the App's services.

3.2 Recipe Imports

When you import recipes from external sources:

  • You are responsible for ensuring you have the right to import such content
  • We do not claim ownership of imported recipes
  • Imported recipes are for personal use only
  • We are not responsible for the accuracy of automatically extracted recipe data

3.3 Our Intellectual Property

The App, including its design, features, and technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer the App.

3.4 Feedback

If you provide feedback or suggestions, you grant us the right to use them without compensation or attribution.

4. Third-Party Services

4.1 External Links

The App may contain links to third-party websites (recipe sources). We are not responsible for their content or practices.

4.2 Third-Party Integrations

We use third-party services (Supabase, RevenueCat, Apple) to operate the App. Your use is also subject to their terms.

5. Disclaimers

5.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5.2 No Guarantee of Accuracy

We do not guarantee the accuracy of recipe extraction or any content in the App. Always verify recipe information before cooking, especially regarding allergens and food safety.

5.3 Service Availability

We do not guarantee the App will be available without interruption. We may modify, suspend, or discontinue features at any time.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or goodwill
  • Any damages exceeding the amount you paid us in the 12 months before the claim

This limitation applies regardless of the theory of liability.

7. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

8. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance.

9. Termination

9.1 By You

You may stop using the App at any time. To delete your account, contact us.

9.2 By Us

We may suspend or terminate your access if you violate these Terms or for any other reason with notice.

9.3 Effect of Termination

Upon termination, your right to use the App ends. Sections 3, 5, 6, 7, and 10 survive termination.

10. General Provisions

10.1 Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

10.2 Dispute Resolution

Any disputes will be resolved through binding arbitration, except for claims that may be brought in small claims court.

10.3 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

10.4 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

10.5 No Waiver

Our failure to enforce any right does not waive future enforcement.

10.6 Assignment

You may not assign these Terms. We may assign them to an affiliate or successor.

Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. In case of third-party intellectual property claims, we (not Apple) are responsible.

By using Get Cooked, you acknowledge that you have read, understood, and agree to these Terms of Service.
